Terms of use
Last updated 12 October 2026
The short version. Cycle Ahead gives general wellness information about training, food and sleep. It isn't medical advice, it isn't a medical device and it isn't contraception or a way to plan a pregnancy. You decide what to do with its suggestions, and you should check with your doctor before big changes. It's a subscription after a 7-day free trial, handled by Apple. Nothing here takes away rights the law says you always have.
1. Who we are, and agreeing to these terms
Cycle Ahead is made by SPENCER AI (ABN 31 978 335 623), Victoria, Australia ("we", "us"). These terms are an agreement between you and us about the Cycle Ahead app for iPhone and Apple Watch and this website (together, "Cycle Ahead"). By downloading or using Cycle Ahead you agree to them. If you don't agree, please don't use it.
You must be 18 or over to use Cycle Ahead.
2. Health: what Cycle Ahead is, and isn't
Cycle Ahead gives general information and suggestions about exercise, food, sleep and wellbeing, based on what you enter and what you allow it to read from Apple Health. Its stages, readiness scores, food targets, forecasts and milestones are estimates made by software. They can be wrong.
- It is not medical, dietary or other professional advice, and it doesn't replace your doctor, a dietitian, a physiotherapist or another qualified person.
- It is not a medical device. It doesn't diagnose, treat, cure, monitor or prevent any disease or condition.
- It is not a method of contraception or a fertility tool. Don't rely on it to avoid or plan a pregnancy.
- It isn't designed for use during pregnancy or breastfeeding. It won't make a plan for you if you tell it you're pregnant or breastfeeding, have a history of disordered eating, or have a heart, kidney or metabolic condition, and asks you to talk to your GP first.
Talk to your GP before starting a new training or eating plan, especially if you are pregnant or breastfeeding, have a history of disordered eating, or have a medical condition, injury or symptoms that worry you. Stop exercising and get help if you feel pain, faintness, chest discomfort or shortness of breath. When Cycle Ahead suggests seeing your GP, please do: it's a prompt, not a diagnosis.
If you're struggling with food or body image, in Australia you can call the Butterfly Foundation on 1800 33 4673. For support any time, call Lifeline on 13 11 14. In an emergency, call 000 (or your local emergency number).
3. Subscriptions and the free trial
- Cycle Ahead is offered as an auto-renewing subscription, Cycle Ahead Yearly (A$39.99 a year) or Cycle Ahead Monthly (A$6.99 a month), or the price shown in the App Store in your country. Either one unlocks everything on iPhone and Apple Watch.
- New subscribers get a 7-day free trial (one per Apple ID). When the trial ends, your Apple ID is charged for the plan you chose unless you cancel at least 24 hours before the trial ends.
- If you subscribe without a trial, payment is charged to your Apple ID when you confirm the purchase.
- Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged within 24 hours before the renewal.
- You can manage or cancel your subscription at any time in your Apple ID settings (Settings, your name, Subscriptions). Cancelling stops the next renewal; you keep access until the end of the period you've paid for.
- Any unused part of a free trial ends when you buy a subscription.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com), and this doesn't affect your rights under consumer law.
- If we change the price, Apple will tell you before it applies, and you can cancel before it does.
4. Your data
Cycle Ahead keeps what you enter on your devices and, if you allow it, in Apple Health. We don't receive it, so we can't back it up or get it back for you. Keeping your phone, your backups and any export you make safe is up to you. Our privacy policy explains this in full.
5. Using Cycle Ahead properly
We give you a personal, non-transferable licence to use Cycle Ahead on Apple devices you own or control, for your own non-commercial use, while your subscription or trial is active. Please don't copy, sell, rebrand or redistribute the app or its content, reverse-engineer or tamper with it (except where the law allows), or use it in a way that breaks the law or harms anyone.
The app, its plans, articles, recipes, exercises, artwork and text belong to us or are used with permission. What you write and log is yours.
Fonts. Cycle Ahead uses the fonts Bricolage Grotesque, Figtree and Instrument Serif under the SIL Open Font License 1.1. A copy of each licence comes with the app and this website.
6. Changes and availability
As far as the law allows, we provide Cycle Ahead "as is" and "as available", without any promise that it will be accurate, complete, uninterrupted, error-free or suitable for your purpose. We may update, change or stop Cycle Ahead or any part of it. If we stop it while you have a paid subscription, we'll tell you in advance where we can.
7. Your rights under consumer law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded, restricted or changed by agreement, including consumer guarantees. If you live outside Australia, you may also have rights under your local law that these terms can't take away. Every part of these terms applies only as far as the law allows.
8. Limits on our responsibility
As far as the law allows:
- we give no promises about Cycle Ahead other than those in these terms or that the law says must apply;
- we aren't responsible for decisions you make about your health, training, food or anything else based on Cycle Ahead;
- we aren't responsible for any indirect or consequential loss, or any loss of data, records, opportunity or enjoyment;
- where the law lets us limit our responsibility for a failure to meet a consumer guarantee, our responsibility is limited to supplying the service again or paying the cost of having it supplied again;
- otherwise, our total responsibility to you for everything to do with Cycle Ahead is limited to the greater of the amount you paid us for Cycle Ahead in the 12 months before the claim, or AUD $50.
None of this limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
9. If something goes wrong
Email welcome@myspencer.ai with what happened and what you'd like us to do, and we'll try to sort it out quickly and fairly. You can also contact a consumer protection agency (in Victoria, Consumer Affairs Victoria), a regulator, or a court or tribunal at any time.
10. Apple and the App Store
If you got Cycle Ahead from Apple's App Store:
- these terms are between you and us, not Apple. We, not Apple, are responsible for Cycle Ahead and its content;
- you may use Cycle Ahead on Apple devices you own or control, as allowed by the App Store's Usage Rules;
- Apple has no duty to provide maintenance or support for Cycle Ahead;
- if Cycle Ahead fails to meet any warranty that applies, you can tell Apple, and Apple may refund the purchase price. As far as the law allows, Apple has no other warranty obligation for Cycle Ahead;
- Apple isn't responsible for any claims about Cycle Ahead, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims. We are responsible for dealing with those;
- if anyone claims that Cycle Ahead, or your having or using it, infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim;
- you must follow any third-party terms that apply when you use Cycle Ahead, such as your mobile or internet provider's terms;
- you confirm that you are not in a country subject to a U.S. Government embargo or listed as a terrorist-supporting country, and you're not on any U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
11. General
Law. These terms are governed by the law of Victoria, Australia. Courts in Victoria can hear disputes about them, but you can also use the courts where you live if your local law gives you that right.
Changes to these terms. We may update these terms, for example when Cycle Ahead or the law changes. We'll update the date at the top and, for a significant change, tell you in the app before it takes effect. A change won't apply to anything that happened before it. If you don't agree with a change, you can cancel your subscription and stop using the app.
If part doesn't work. If any part of these terms can't be enforced, it's cut back only as much as needed, and the rest still applies.
No waiver. If we don't enforce something straight away, we can still enforce it later.
The whole agreement. These terms and our privacy policy are the whole agreement between you and us about Cycle Ahead.
Moving the agreement. We may transfer these terms to another business that takes over Cycle Ahead, as long as your rights under them stay the same.
